These Terms and Conditions set out the basis on which we provide our rubbish clearance and waste collection services within Richmond upon Thames and surrounding areas. By making a booking, accepting a quotation, or allowing our operatives access to your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

Company, we, us or our means the rubbish clearance and waste collection service provider trading under the name Rubbish Clearance Richmond upon Thames.

Customer, you or your means the individual, business, landlord, managing agent, tenant or other party who requests or accepts our services.

Services means any rubbish clearance, waste removal, waste collection, loading, transportation, or related services that we provide.

Waste means any rubbish, junk, household waste, commercial waste, garden waste, bulky items or other materials that we agree to remove, subject to the exclusions in these Terms and Conditions.

2. Scope of Services

The specific scope of Services for each booking will be agreed with you in advance, usually via a quotation or estimate.

We reserve the right to refuse to collect any items that in our reasonable opinion are hazardous, prohibited, unlawfully stored or transported, incorrectly contained, or likely to cause damage or injury.

We do not provide specialist removal of certain types of waste such as asbestos, clinical or medical waste, biological or infectious waste, chemicals, solvents, liquids, gas bottles, pressurised containers, or any other materials requiring specialist licensing or treatment, unless expressly agreed in writing in advance.

3. Booking Process

You may request a booking for our rubbish clearance and waste collection services by telephone, email or through any other contact method we make available. You must provide accurate information regarding the type and quantity of waste, access to the Site, parking arrangements, floors or stairs involved, and any other relevant details.

Based on the information you provide, we may give an estimate or an indicative quotation. Final prices may be confirmed once our operatives attend the Site and assess the actual volume and nature of the waste.

A booking is only confirmed when we have accepted your request and provided a date and time window for the Services. We may also require confirmation by email, text or other written method. We reserve the right to refuse any booking at our discretion.

4. Access and Parking

You are responsible for ensuring that we have suitable access to the Premises at the agreed time. This includes providing accurate directions, ensuring someone is present to grant access if necessary, and making sure that any gates, doors or security arrangements allow our operatives to enter and carry out the work safely.

You must also ensure that there is reasonable and lawful parking available for our vehicles as close as reasonably possible to the Premises. Any parking fees, permits or charges that apply as a result of carrying out the Services will be added to your invoice unless otherwise agreed in advance.

If access or parking is not available, significantly restricted, unsafe, or not as described at the time of booking, we may cancel or rearrange the booking and may charge a call-out or cancellation fee as set out in these Terms and Conditions.

5. Quotations, Estimates and Pricing

Any prices we provide prior to attending the Premises are usually estimates based on the information you supply. Final prices are typically calculated based on the volume, weight, type of waste collected and time taken, in line with our current pricing structure.

Where possible, we will confirm the price before loading any waste. If the actual waste to be removed is significantly different in volume or nature from what was described at the time of booking, we reserve the right to adjust the price accordingly or decline to proceed.

All quotations and estimates are exclusive of any applicable taxes unless explicitly stated otherwise. We may charge additional fees for extra labour, difficult or unsafe access, heavy items, disassembly of goods, or where waste requires special handling or disposal.

6. Payments and Invoicing

Unless otherwise agreed in writing, payment is due in full on completion of the Services on the date of collection. We may accept payment by cash, card or bank transfer, subject to availability and agreement at the time of booking.

For business customers and account holders, alternative payment terms may be agreed in writing. Where an invoice is issued on credit terms, payment must be received by the due date specified on the invoice. Late payments may incur interest and administrative charges in line with applicable UK law.

We reserve the right to withhold services or suspend further collections where outstanding invoices remain unpaid. Title to any goods or waste does not pass to us until payment has been received in full, although we may still proceed with the disposal of waste in the normal course of service.

7. Cancellations and Amendments

You may cancel or amend a booking by giving us reasonable advance notice. We ask for at least 24 hours notice for standard bookings. Where less than 24 hours notice is provided, we may apply a cancellation fee or charge for any costs already incurred, including travel or staffing costs.

If we arrive at the Premises at the agreed time and are unable to carry out the Services due to lack of access, unsafe conditions, incorrect information, or your decision not to proceed, we may charge a call-out or cancellation fee.

We reserve the right to cancel or reschedule a booking due to circumstances beyond our reasonable control, including but not limited to vehicle breakdown, staff illness, severe weather, accidents, or other operational issues. In such cases, we will endeavour to offer an alternative time or date, but we will not be liable for any losses or costs you may incur due to the rescheduling.

8. Customer Obligations

You confirm that you are either the owner of the Premises or have the authority of the owner or occupier to arrange for rubbish clearance and waste removal. You also confirm that you have the right to dispose of the items presented to us.

You must ensure that waste intended for collection does not contain prohibited or hazardous materials and is reasonably accessible. You should clearly identify which items are to be removed and which are to remain. We are not responsible for any confusion where items are not clearly indicated.

You agree to provide a safe working environment and to notify us of any potential risks, such as structural issues, sharp objects, contaminated areas, or the presence of hazardous substances. We may refuse to carry out Services if we consider the conditions to be unsafe for our operatives.

9. Waste Handling and Environmental Compliance

We are committed to providing rubbish clearance and waste collection services in compliance with relevant UK waste regulations. We will only transport and dispose of waste using appropriate licensed facilities and in accordance with applicable environmental legislation.

Once waste has been collected from your Premises and loaded onto our vehicles, it becomes our responsibility and we will manage its transfer and disposal. However, you remain responsible for ensuring that the waste presented to us is lawful to dispose of and does not breach any regulatory requirements.

We may refuse to remove any waste that we reasonably suspect to be hazardous, prohibited, or not disclosed at the time of booking. In such cases, you may be responsible for any costs or penalties arising from misdescription or non-compliance.

10. Liability and Limitations

We will exercise reasonable care and skill in providing our rubbish clearance and waste removal services. However, our liability to you is limited as follows.

We will not be liable for any indirect, consequential or economic loss, including loss of profit, business interruption, loss of opportunity or loss of data, arising out of or in connection with our Services.

Our total liability in respect of any claim arising out of or in connection with the Services, whether in contract, tort including negligence or otherwise, shall not exceed the total fees paid or payable for the specific booking giving rise to the claim, except where such limitation is not permitted by law.

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under UK law.

You are responsible for safeguarding any items or property that are not intended to be removed. We will not be liable for the loss of items that you fail to distinguish from waste, unless caused by our wilful misconduct or gross negligence.

11. Damage to Property

Our operatives will take reasonable care when carrying out rubbish clearance and waste collection, including when moving items through your property. You acknowledge, however, that minor scuffs, marks or wear and tear may occasionally occur, particularly in tight spaces or when removing bulky items.

If you have any particular concerns about floors, walls, door frames or other surfaces, you should notify us before we commence work and take steps to protect them where necessary. We are not responsible for pre-existing damage or conditions.

Any claim for damage must be notified to us in writing as soon as reasonably possible and, in any event, within 7 days of the Services being carried out, providing photographs and reasonable details. We may request access to inspect the alleged damage. Our liability for proven damage will be subject to the limitations set out in these Terms and Conditions.

12. Insurance

We maintain appropriate public liability insurance and, where required, employer liability insurance in connection with the provision of our rubbish clearance and waste collection services. Details of our insurance can be made available upon reasonable request.

13. Complaints and Dispute Resolution

If you are dissatisfied with any aspect of our rubbish clearance or waste collection services, you should notify us as soon as possible so that we have an opportunity to investigate and, where appropriate, put matters right.

Complaints should be submitted in writing, providing your contact details, the date and location of the Service, and a description of the issue. We will aim to acknowledge and address complaints within a reasonable period of time.

We may propose corrective work, a partial refund or other resolution where we find that our service has fallen below a reasonable standard. This will be without prejudice to your legal rights under UK law.

14. Data Protection and Privacy

We may collect and process personal data about you in connection with handling your enquiry, managing your booking, and providing our Services. This may include your name, contact details, address, and payment information.

We will handle such information in accordance with applicable data protection laws and use it only for legitimate business purposes such as scheduling collections, invoicing, customer service and legal compliance. We do not sell your personal data to third parties.

15. Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms and Conditions to the extent that such delay or failure is caused by circumstances beyond our reasonable control. This may include, without limitation, extreme weather, acts of God, strikes, industrial disputes, accidents, road closures, vehicle breakdown, civil unrest or changes in law.

16. Changes to These Terms and Conditions

We may update or amend these Terms and Conditions from time to time to reflect changes in our services, legal requirements or operational practices. The version in force at the time of your booking will apply to your specific Service.

It is your responsibility to review the current Terms and Conditions whenever you arrange new rubbish clearance or waste collection services with us.

17. Severability

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, such provision shall be deemed deleted to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

18. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them or the provision of our rubbish clearance and waste collection services shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services provided, or their subject matter or formation.

By proceeding with a booking or allowing our operatives to commence work, you confirm that you have read, understood and agree to these Terms and Conditions.
